My boyfriend finished pc1000 but hasn't shown completion. He got busted with pot and went to jail. What would be his consequence? He finished pc1000 but his court date for dismissal was until March. He got busted with pot and was arrested in there for 2weeks. He has several court dates until 7th of February, what could be his consequences?

If a person is found in violation of PC 1000 then they are put back into the same place they were when granted PC 1000. Your boyfriend may get violated and set up with a prop. 36 program. He could be back to pleading out both the PC 1000 case and the new weed case. How this comes out will depend on the facts of cases, your boyfriend's attitude, and your attorney's ability.

Technically he's violated the terms and condition of PC 1000 and therefore could lose the benefit of (keeping the conviction off his record and avoiding being a registered drug offender pursuant to HS 11590). Sometimes the DA will negotiate reinstatement or in this case admit he completed DEJ and allow him those benefits. If not, since new charges are drug related you would normally roll PC 1000 into Prop 36, but then you lose the benefits set forth above, although is successfully complete can request to be placed on calendar and move to dismiss charges and eliminate registration requirement post successful completion.
