Do I need to accomplish some documentation to take a child home? 3 Answers as of January 25, 2012
My cousin wants to give my husband and I her unborn child. We want to start with legal guardianship because adoption is too expensive. I was told I cannot file for guardianship until the child is born. Does this mean that I just take the baby home once it is born and then file legal guardianship or do I need some documentation to take the child home? You just take the baby and then you can file the guardianship.

If your cousin is near term, it makes sense to at least file a petition for guardianship and once the child is born file a stipulation with the court that you and your husband will be granted guardianship. Please note the biological father must be served the guardianship petition and any related documents and motions.

Take the child home and file your documents the same day. For the most part they can be prepared in advance of the birth. Remember that a guardianship can always be undone.
