Is what the breeder did legal, or is it a breach of contract? 1 Answers as of August 11, 2015

I need to know what our options are. On Monday (8/3) we drove 2.5 hours to meet a dog breeder, liked the puppy we went to see, and put down a deposit, and got a contract stating we had already paid the deposit and we were to pick up the puppy on August 15th. On Wednesday at about 8:30 pm (8/5) we were called by the breeder and said she could no longer sell us the puppy because the person she co-owns the male she used to breed her dog with said he wanted the puppy. We had already traveled 2.5 hours to and from, and had left a deposit. We were already in love with the puppy, very excited to be getting her, already bought her some things, picked out a name, and couldn't wait to have her home, and our hearts were shattered by this. With the fact we had already payed a deposit and a sales contract had been written up is it legal that she did this? We got the deposit back, but what she put our family through is inexcusable.

Depending on the terms of the contract able to force the breeder to provide you the dog getting what is called specific performance. Consider getting legal counsel to prosecute this for you.
