The answer to your question first depends on what chapter of bankruptcy you filed under. If it is a Chapter 7, then, no, there are statutory time periods which must be endured prior to receiving a discharge. A chapter 7 bankruptcy, however, takes around three months from the time of filing. Under a Chapter 13, which is a payment plan you enter into and is typically 60 months (5 years), you can achieve a discharge early if your income increases greatly and you pay-off the agreed amount prior to the end of the 60 months. Do you have an attorney? That's the first step. In my experience the biggest factor in getting a case filed quickly is the client. You need to do your credit counseling course before you can file. You need to give your attorney EVERY document he requests. You need to pay your fee in full. Finally, you need to meet with your attorney to review and sign your petition, schedules and statements.

It depends a bit on what you mean by expedite. If your question is whether it is possible to file the case quickly, then the answer is yes. You can file a skeleton petition, but you will need to file all the remaining and supporting documentation necessary within 2 weeks of filing. If you go this route it is important to understand what information and documentation your attorney will need and be able to get all of the necessary documents together fairly quickly. If you are unable to put everything together in a timely fashion that your case will most likely be dismissed automatically at the end of the two week grace period. In my experience, unless there is a pending foreclosure that you need to stop, there is usually no reason to file in this manner. You should talk to an attorney about your specific situation sooner, rather than later, to determine whether there is a need to rush. Often rushing in without a solid strategy can be problematic for your case.

    If a debtor has all required information at hand and a valid money order, he can file as fast as within a day or two. In a super emergency, it can be done the same day as a emergency partial petition (it costs more in legal fees because the attorney needs to bump aside existing client work and do more work to supplement the petition post-filing, but it can be done). According to the latest court rules in NJ, the mandatory counseling course can now be done the same day as filing (it used to be the day before filing), which speeds things up when someone is told the loan mod did not come through and is now racing a sheriff's sale in a few hours.     It is pretty standard, but some attorneys can and do file quicker than others. Generally we find that we are waiting longest on the client to get us the documents we need to prepare the filing. But by all means, ask the attorney how long they generally take between the times you meet with them and when your case will be filed. In some situations it is possible to file an emergency bankruptcy, however at least in my office, we find that it takes the same amount of time to just go ahead and do the whole thing. Good luck!

    I dont know what you mean by cover your debts, but there isnt a way that you can ask the court or the trustee for a quicker process. If youre doing what we call a standard chapter-7 no-asset bankruptcy which is what the vast majority of bankruptcies are then you can expect to receive a discharge order within about three months from the date you file for bankruptcy. This is assuming, of course, that you have everything in order when you file and that none of your creditors cause any trouble along the way (and usually they dont cause trouble).
