Is there anything I can do about the lien since it was against previous owner not me? 1 Answers as of July 12, 2011

What if I sold a property and financed it myself but property was returned to me due to non payment? Now my property has a lien from previous owner who has declared bankruptcy. Is there anything I can do about the lien since it was against previous owner not me?

A lien is against the property, not the person. If there is a lien on the property, it may depend on whether your lien is ahead of it or behind it in priority. If you took a deed in lieu of foreclosure you may be stuck with the lien on the property. If not you should foreclose your lien, assuming it is a superior lien, and that process will wipe out any inferior liens to yours.
