Is there an issue with getting a MIP in a gated community? 1 Answers as of July 07, 2011I got an MIP tonight, and technically I was in a gated community behind the fence when the sheriff called me to his car where he proceeded to Breathalyzer me and I failed. Is there any kind of issue here that would make a standing in court to prevent community service, probation, too large of a fine, or a loss of license for me?

Based on your information, I don't think the gated community part matters. MIPs are common enough that you are not going to ruin your chances at college, or anything like that. However, they do carry fines and possible jail time and it is best to hire an attorney to address this. Also, once you turn 21 you can have the case expunged as long as you handle the case correctly.
