Is my landlord included in the bankruptcy? 3 Answers as of November 04, 2010In April of this year I filed a Chapter 7 bankruptcy. In August of this year we got evicted from our home. The landlord was not listed on the bankruptcy and the bankruptcy discharged in September of this year. Am I liable for the charges due to the landlord or would they consider the bill to be included? This was a no asset case.

If your case was filed in the 9th Circuit (which includes California, Oregon, Washington, Nevada, and Hawaii), then your debt to the landlord was discharged along with your other debts despite not having listed them on your bankruptcy papers. The relevant case that so held is In re Beezley, 994 F.2d 1433 (9th Cir. 1993).
