Is a marijuana with DUI the same as a DUI for alcohol? 4 Answers as of April 20, 2015

I was arrested for a driving under the influence of marijuana in Long Beach, CA. I want to fight it because I don’t think the cop had an actual reason for pulling me over in the first place. I also had some on me (about a gram) and they charged me with 2 more crimes. Can they do that?

Yes. You cannot be under the influence while driving a motor vehicle. No matter the substance.

The consequences are the same, but drug DUIs are a lot more defensible, since there is no statutory limit that deems you impaired. But you'll need to hire a DUI specialist.

They have the same penalties. Don't take a plea. These cases are extremely hard for the DA to prove. If you fight it you can get it reduced or dismissed.
