Is it safe for me to file a N-400 even if we are divorced? 1 Answers as of March 23, 2011

I got a 10-year green card through my ex-husband. We are divorced already. Is it safe for me to file a N-400 even if we are divorced? I got my permanent resident card on Aug. 2006 and the divorced was finalized on Aug. 2009. Plus my divorce decree said that I should restore my Maiden name. If I apply for N-400 should I put my "current legal name" as my maiden name or my ex husband's last name as it appears on my green card? Thank you!

If you have been a lawful resident for four years and nine months you are able to naturalize, even if divorced. You still need to make sure you meet all other eligibility requirements too.
