Is it possible to get one or both of my DUIs expunged? 8 Answers as of February 21, 2012

I was wondering if it is at all possible to get one or both of my DUIs expunged? I received them both in April of 2007 back to back , being dumb and immature. I'm currently in the California Army National Guard and am on a deployment in Afghanistan for a few more months. I have payed all my fees and completed all of the necessary DUI courses on time a few years ago and have not been in any trouble since. I also currently have a CA DL and M1 license. Just wondering if there is anything I can do because I know I messed up but my life has changed a lot in 5 years and what to be able to get a better paying job after my deployment is up.

Yes, it is possible to have your DUI convictions expunged. It is a very simple process. Basically just filling out paperwork. However, if you are currently on probation for either of those cases or a different case, that can delay or stop the expungement proceedings.

The good news is that probably both can be expunged. The bad news is that they are still on your record (but they are dismissed). You can apply for an expungement through the Department of Revenue or hire a lawyer.

Each county has a different procedure and it can be done with or without an attorney. Sometimes you are entitled to an expungement; sometimes it is discretionary with the judge. DUI expungements are discretionary and an attorney could help. He or she would likely seek the route of a formal motion before the court which also could be done much sooner than the administrative way. Costs vary with attorney to attorney. In such things where the lawyer makes a difference you get what you pay for.

Yes, they can be "expunged" - but... a few words about that. California doesn't really have an "expungement" law. Some states allow you to get things taken off your record with an expungement. California has a section that everybody calls the expungement section, but it's really a dismissal. If your request is granted, it adds a notation to your criminal history that the case was subsequently dismissed. It remains on your record, but it will allow you to tell *most* private employers that you did not have the conviction. Keep in mind that it may still have to be disclosed in some circumstances. An "expungement" in California also does nothing to your DMV history. If the job you're applying for requires a DMV printout, the DUI convictions will show up on there, so ... it may be better to disclose and explain that they were expunged and then tell them how your life has changed, etc. You can discuss this with a criminal defense attorney that routinely practices in the county where your cases were and go from there.

Maybe someone else will offer detailed information. In general in California misdemeanor convictions can be expunged after completing probation uneventfully, as you have. Go to google and do a search such as"California misdemeanor expungment". A form should be available. You send it to the county of your conviction with proof of service on the District Attorney. This is a simple process.
