Is it possible for me to lose at trial or should case be dismissed if I refused to drive but was charged with DWI? 1 Answers as of May 30, 2014

After the owner of a house asked me to leave there property, they called the cops because I said I was too drunk to drive. I refused to drive. When the cops came, I was charged with DWI. How is this possible?

Presumably the owner of the house and the police are telling a different version of events. Although NY has a much broader definition of operation than driving. Were you in the drivers seat with the engine running?
