Is it illegal for me to take my daughter with me to my mothers house in Florida while her father stays in New Jersey at his mothers house? We are married. I'm looking to leave because he has gone to jail before for holding me against my will in an apartment and recently has been verbally abusing me and has gotten rowdy in front of our daughter. The only place I can go at the moment is to my mothers house in Florida until I get back on my feet again and I need to know if I can take my daughter with me.

It is legal if you have either a court order or the child's father's written permission. The court usually grants one parent the right to remove the child from the jurisdiction if the moving parent is not moving just to separate the parent and child or to otherwise hurt the non-moving parent, AND, and this is a big AND, the moving party can come up with a visitation plan so continue the bonding between parent and child.

What you really need is a divorce and a Court Order that gets custody to you, and child support, and allows you to do this.
