Is it legal for someone to file a case against the victim? 2 Answers as of December 27, 2011
My brother has been stabbed 5 times and barely survived but is recuperating now. We obviously want to file charges, but the culprit's family is threatening to file charges too to my brother who has stabbed their relative years ago because of self defense. People can certainly report anything they want to the police. If true, the report is permitted. If false, that would be a crime. The police may refuse to file charges based on the report if the statute of limitations has already expired or if they simply do not believe the report.
