Is it legal for my employer to make additional charges for individuals health insurance if they smoke? Posted on June 06, 2011

My employer is charging an extra $10 fee every pay period if you smoke, for your health insurance. They're also requiring that you take a biometric screening that checks your blood pressure, weight, cholesterol, etc or you also have to pay an additional $10 a pay period (bi-weekly) for your health insurance. Is that legal?
