Is it legal for the mother of my child went to a doctor's appointment without me knowing? 4 Answers as of January 25, 2012

My Daughter is 2 years old, we have already established paternity. The mother is fighting against my custody claim by saying that she needs to breast feed for another year during the nights and cannot spend the night at my house. We have gone to doctor appointments together and all the doctors have said she can go without the breast milk. She booked a doctors appointment without my knowledge and went to it and the doctor wrote a note saying she needs to breast feed for another year during the nights. Is that illegal that without my knowledge took our daughter to a doctor? I understand in the case of an emergency not needing consent but I was under the impression that I was to be invited to all appointments. We have split legal rights for the child.

It wasn't illegal unless it violated an existing court order. If a Paternity case hasn't already been filed, you should file one, as well as an Order to Show Cause requesting orders that you be advised in advance of the details of any and all health-care appointments of your child, and authorizing you to be present at any and all of those appointments.

Unless you have a court order barring your ex from taking the child to the pediatrician without you being present, she is not in violation of your parenting court order. If you dispute your ex's claim that the child must breastfeed at night, you are required to produce contrary evidence preferably from a qualified pediatrician to support your position.

It is not illegal for her to go to the doctor without telling you. It might be a violation of the custody order but it should not be illegal. If you have a custody order, then you can take her back to family law court for a violation of those orders and you could ask for a breach of court orders.
