Is it legal for a company to under time employees for weeks at a time? Posted on May 05, 2011

Since March 17th, my fiancé has taken four days off work for FMLA, has worked 4 days, and has been under timed every other workday (Monday-Friday). Obviously the company would rather under time than pay layoff costs, but is it legal for a company to continue to under time for weeks at a time?
