It depends on why he is holding a paycheck. The Federal law requires you get paid for all hours worked, but the employer can consider offsets. So it is what has been agreed upon with the employer.

Generally, was holding a paycheck is not a normal action by an employer. However, it is not necessarily illegal depending on the reasons for doing such. Therefore I would have to have more information regarding the facts and circumstances before rendering an opinion.
