It is legal but sex would be statutory rape since you cannot legally consent. I suggest you find a boyfriend closer to your own age for a number of reasons that you would not understand or agree with, but which will be important should the relationship get serious or continue.

I would need further information to answer better, such as is this in NY state, etc, but generally if you are not having sex than you are not breaking the law. The law prohibits sex with an underage person.

There is no law against this, however, if you two engage in any kind of criminal conduct whatsoever, including taking alcohol, he can be charged with contributing to the delinquency of a minor. Of course, ANY sexual contact of any kind is illegal. Why not date somebody your own age?

Whether it is legal or not for a 25 year old to date a 16 year old depends on what you mean by ?date?. If during your date any he uses a you to transport drugs, asks a you to meet for a "secret rendezvous", knowingly provides a place to engage in sexual activity, engages in sexual activity with you, asks you to pose nude...or even partially nude...for pictures, and furnishes you with alcohol. These acts would be a violation of California Penal Code Section 272m Contributing to the delinquency of a minor. Penal Code 288 PC California's lewd acts with a minor law prohibits touching a child anywhere on the body...even on the outside of the clothing...if the touching is done "with the intent of arousing, appealing to, or gratifying the lust, passions or sexual desires of the perpetrator or the child". California Penal Code section 261.5 ?stat rape? Unlawful sexual intercourse is an act of sexual intercourse accomplished with a person who is not the spouse of the perpetrator, if the person is a minor. For the purposes of this section, a "minor" is a person under the age of 18 years and an "adult" is a person who is at least 18 years of age. (c) Any person who engages in an act of unlawful sexual intercourse with a minor who is more than three years younger than the perpetrator is guilty of either a misdemeanor or a felony, and shall be punished by imprisonment in a county jail not exceeding one year, or by imprisonment pursuant to subdivision (h) of Section 1170.

It is not a good idea at all, the 25 year old should not even date, because he can be charged with sexual battery whether sex occurs or not. This is a very serious crime and he could go to prison. Why take the chance?
