No, it is a matter of tactics and Judgment. However, if claim is rejected, the attorney should reasonably make a decision if he wants to pursue the case, if the case has merit and in such case file the lawsuit.

It's not a breach of contract; the attorney can always drop the case. Sometimes a case is so small that a law suit is not warranted. Perhaps you should talk to another lawyer, or consider Small Claims Court.
