If you get five years, you get five years in prison. You do not apply for probation. The judge will either probate the sentence at the time it is given or not.

I would need further information to answer such as the exact charges and the exact sentence.When you say sentenced to 5 years do you mean 5 years in jail or 5 years probation. If you are sentenced to probation you go to the probation department and they set up up a schedule of when you have to report and anything else you have to do as part of probation. It depends if you get probation. You might get five years in jail. If you get probation. You will be put on probation for a certain amount of time, and if you get in trouble while on probation you serve the sentence.
