If my I130 was approved, how long will it take to complete a case? 9 Answers as of October 20, 2011

I am a permanent resident (green card holder). I applied for my wife which is in Kosovo (Europe) to get a (2A) visa. I-130 its been approved in a September 29, 2011. I'm waiting my case to move in a national visa center. My question is how long from now can she get a visa? How much more do I have to wait?

Probably 30 months or less since this category is advancing quickly. You can speed it up if you become a citizen.

The answer to your question is it depends upon visa availability. Your wife is the beneficiary of a preference petition, which means that she does not have a visa immediately available to her. This month visas are available for cases filed on or before January 8, 2009. Visa availability changes monthly.

From what you’ve mentioned, your wife’s case has a priority date of September 29, 2011. The November 2011 Visa Bulletin shows that the current date is February 15, 2009. That means that those applications with priority dates of February 15, 2009 or earlier are the application being processed now. You will need to monitor the Visa Bulletin on a monthly basis and when the F2A category reached your priority date, than your wife’s case will be processed.

The current processing time for spouses of permanent residents from Kosovo is February 15, 2009. That means that the Department of State is issuing immigrant visas in this category to individuals with a priority date of February 15, 2009. You can access information about processing times for visas at the Department of State Website. Once you are at the website, search for visa bulletin. Or click this link: http://travel.state.gov/visa/bulletin/bulletin_5572.html Visas are distributed based on the relationship and country of origin. Since you are a permanent resident, you are in the FB-2A category. If you get citizenship, there is no limit on the number of visas that can be granted and your spouse could immigrate very immediately.

The US Department of State publishes a visa bulletin every month that explains how long the wait is for each category of immigrant visa. The November Bulletin states that F2A applicants with a priority date of Feb 15, 2009 are eligible to apply for an immigrant visa. This would indicate that if you filed an I-130 petition for your husband now, he would have to wait about 3 years to apply for an immigrant visa.

You will have to wait a few years and no one knows exactly how long. What you do is that you go to the USDOS website at http://www.travel.state.gov/visa/bulletin/bulletin_5560.html
