My understanding is that they can only ask if a person has been convicted of a crime. Anyone can get arrested.

    Most job interviews/applications ask about convictions not arrests since many people are arrested who don't end up being prosecuted or convicted. If he was convicted of DUI 20 years ago he may choose to hire a lawyer to "expunge" his record this will offer some insulation from these types of questions as he heads into the job search.

    Yes. If the potential employer asks if he has ever been arrested, the honest answer is yes. The fact that it was 20 years ago doesn't mean your husband gets to just forget about it and lie when someone asks about it.
