If my 15 year old son does not want to visit his dad, during his dad’s time to have him does he have to go? 2 Answers as of September 08, 2014

Both parents share joint legal and physical custody. For the past year, time has been split equally with both mom and dad. The child is with mom for 7 days and then stays with dad for 7 days. Recently, my son has expressed his opinion and he does not want to go for his dad’s week that is supposed to begin today at 5:00 pm.

If the child can articulate specific reasons, then file a motion to modify the visitation. If the court finds the reasons and modification are in the child's best interest, then the Court would modify the visitation.
