Can I now sell my house? 5 Answers as of February 22, 2012

If I put my house up for bail and the federal case is dismissed without prejudice, can I now sell my house? A family member was accused of mailfraud and I put up my home for $250,000. I know the case was dismissed without prejudice. Is my home released? I haven't figured it out yet.

I can not answer without further information. Generally without prejudice means the case can be refiled. I suggest you contact the court about the bail and ask them.

The house is free once the bail is remanded. Just call the clerk and ask.

You must ask the Clerk of the Court or his attorney since bail is only given back after the case is over and this charge may be re-instated. You may be able to revoke the bail but that might be a problem with the defendant.
