How can I file at Small Claims when I don't know where the guy is? 2 Answers as of December 01, 2011

I had given someone I considered a friend $1200 for a car that he stated he had found for me. He left this state as he said he had found it back home in OH. He texted me a few days ago stating he was back but would not answer any calls or text messages. His number has now been disconnected and I do not know where he is. I have spoken to the police who stated it is a civil matter. I cannot file in small claims without an address to have him served at. Is there anything that can be done at this point or am I just completely out of luck?

You can still sue him and you have 90 days to serve him, but if you cant find him, it is unlikely that you will ever collect. Don't give friends money unless you intend to give your friend money. Sorry.
