You are eligible to obtain a discharge in a Chapter 7 case after 8 years have passed from the commencement date of the last bankruptcy you filed. You are eligible to file a Chapter 13 bankruptcy and receive a discharge 6 years after the commencement date from your last bankruptcy you filed. A Chapter 13 is a 36 or 60 month repayment plan bankruptcy. I hope you found this answer useful.

You can file another Chapter 7 after September of 2013, but be cautious, you cannot file before the day you filed eight years ago. So you file after the date you filed in 2005. For example, if you filed on September 1, 2005 then you can file again on September 2, 2013. So look at the day you filed and you can file the day following.

The bankruptcy law changed in 2005. You have to wait for 8 years before can file another chapter 7, so you can file in October of 2013. You do have the option of filing a chapter 13, and later convert it to chapter 7.

Under BAPCPA (the bankruptcy law that went into effect in October of 2005), you can now file Chapter 7 bankruptcy and receive a discharge once every 8 years. So after the 8 year anniversary of your filing date this September, you would be eligible to file Chapter 7 again and receive a discharge (assuming that you qualify). You are eligible to file Chapter 13 and receive a discharge now (of course you would have to make the payments required by your Chapter 13 plan to be entitled to a discharge).
