I bought a house on contract and the owner had the house torn down before my first payment was due, what can I do? Posted on February 04, 2011

Bought the house in 2009 and did the first homebuyers refund on our taxes, our first payment was due in Sept 2010, but the owner was first going to sell the property to the neighbor that summer of 2010 and he got into it with my husband over it. Now the house has been torn down by the owner, but it is still in my husband and my name and the property is up for sale by the owner. Since we dont live in the house ( no house there to live in) we have to pay back the first homeowners tax credit. What can we do if anything?
