How much time will one have for getting a third DUI on a suspended license? 8 Answers as of July 16, 2015

My boyfriend got caught driving on a suspended license and he also got his third DUI within 5 years. How much time do you think he will get if any at all?

He's probably looking at felony charges. He's presumed innocent until proven guilty beyond a reasonable doubt. He has a right to counsel. If convicted of a felony charge, the court will look at his guideline scores and determine the appropriate sentence. People with bad criminal histories or other factors, though, may score high enough that they could be looking at prison if convicted. It all depends on the alleged circumstances. Additionally, he is looking at additional license sanctions from Department of State as well. He should either request a court-appointed lawyer or retain a lawyer.

How much time he faces depends on the Blood Alcohol level in his system at the time. For .08% - .99% he would be facing 10 days to 2 years in prison, between.10% and .159% 90 days to 5 years and .16% or higher 1 to 5 years in prison. If the suspension was DUI related he might face an additional 60 days to 2 years in jail depending whether this was his first conviction for driving with a DUI related suspension, his second conviction or his third.

In Wisconsin a third offense OWI carries mandatory jail time. The length of his sentence will depend on the blood alcohol content that was measured and the severity of his impaired driving. He can shorten the jail time by enrolling in a treatment program which he might benefit from for other reasons as well He needs a lawyer experienced in drunk driving defense. Good Luck. `
