Until the statute of limitations expires any and every civil or criminal case can be dismissed by plaintiff w/o prejudice so long as defendant hasn't been served and responded to the summons and complaint after defendant responds then dismissal with or w/o must be with defendant's stipulation other scenarios are possible but these would be most common.
