We had the child taken into protective custody in her county in the past he is 6 years old and she has not put him in school he has been living with us for 9 months now. Mother is a drug addict. we got a lawyer and filed emergency custody. It has been 2 months and we haven't heard from the lawyer about a court hearing. Should we be concerned?

Emergencies are heard the same day, or at worst assigned to an expedited hearing date, usually within 7 days. So it sounds like nothing has been done since even on the regular motion calendar you should have been in court within 30 to 45 days of filing, and thats the regular calendar. What you should do before speaking with the attorney is this go to the clerks office and find out if anything has been filed under your names, but what would be your bases for custody you are not relatives correct?
