How long does the I130 process take? 12 Answers as of December 19, 2011

I am from Bangladesh. My uncle applied for my family in 2005 and we are on 2011. When I checked my case status, it says "On January 26, 2010, we shipped this approved or re-affirmed case to the Department of State for visa processing". May I know please how much time can this take now?

It shouldn't take too long, but it also depends on a few factors.

If your uncle filed for his brother/sister, then the case may take 10 or 12 total years to process.

You will be notified by the National Visa Center as will be the petitioner, when it is time for the next step (consular processing) because you/petitioner will need to submit additional fees for the visa processing and affidavit of support as well as provide additional documentation. Make sure that your current address is what the NVC has for you and for the uncle; otherwise, they will not be able to reach you and the petition could be abandoned.

You can check with the DOS visa bulletin and it will give you an idea as to when your visa might become available. It is a long way out though. Good luck!

It should not take so long. If the priority date is current, you can make an inquiry with the consular post.

There can be a very long wait for I-130 petitions (especially those filed by siblings, as it sounds like this might have been) for Indian citizens to become "current" and become a basis for residency.

If your uncle is a USC and sponsored a sibling, the current wait it about ten years from time of filing. So you have about four years.

It is almost impossible to get a firm processes period from the USCIS the best you can do is to go with the estimates they post on their website. The good news is that you're getting close. Good luck!

Based on the work flow of the US Consulate handling immigrant visa petitions, it normally takes about 6 - 9 months to be called to the consulate for an interview. You should have heard from the Nation Visa Center which processes the case after the I-130 approval and sends it to the consulate for the interview. You can retain counsel to follow up with USCIS, National Visa Center and the US Consulate.

If your Uncle applied for his brother, there are numerical limitations that cause backlogs. You need to periodically check the visa bulletin to find out how far behind right now. If you look at the visa bulletin for "all chargeable areas except those listed" you will see for Family Based Fourth Preference" (brothers and sisters of US. Citizens) that the current priority date is August 15, 2000, so you still have some time to go. The visa bulletin can be found at http://travel.state.gov/visa/bulletin/bulletin_1360.html .

That question cannot be answered simply. It depends on several factors., such as your citizenship or reasidence status. You must have an approval notice from the INS of thev petition you filed. You may ask the U.S. Consulate for a written reply and should consult with a lawyer ,showing all the papers you have, for a more accurate reply. You will also have to show that you are able to support them when they arrive.

The length of time it will take depends upon immigrant visa availability. Unfortunately, I do not have sufficient information to estimate how much longer you will be waiting as depends upon what class you fall in as well as priority dates. You can find visa availability information at this website: http://travel.state.gov/visa/bulletin/bulletin_1360.html. January 26, 2010, we shipped this approved or re-affirmed case to the Department of State for visa processing".
