You do NOT have to wait to move out to file for divorce. In fact, many attorneys would recommend that you not vacate the marital home until after the divorce has been commenced; especially if this is a primary asset of the marriage that is going to be in dispute. However, if your personal safety is at issue, you should think twice before deciding to stay (no property or monetary value is equal to your safety and well-being). Before you file for divorce in any state, you should check to see what residential requirements are needed to be met before you can file in that state.
