How does personal injury work when injured out of the country? 1 Answers as of November 03, 2010

When I was on vacation in Jamaica, I was rear-ended hard. It was really obviously his fault, and I have not had any problems with my car insurance, but my back has hurt badly since the crash. I am back in the US now. Can I sue for the injury? How does personal injury work when it happened out of the country?

Generally, a lawsuit must be filed where the accident occurred and/or where the at-fault person resides-this could be in Jamaica. If the at-fault-person had insurance and you have this information, you may be able to resolve the claim through negotiations here in the U.S. However, if he did not have insurance, you would have to speak with an attorney there who is familiar with the law and their insurance requirements-if any.
