How do you prove that you were not trying to evade arrest in North Carolina? 1 Answers as of November 10, 2010A cop tried to pull me over when I was on the freeway. I got off because I did not see a place to stop and then I pulled over, but he thought I was trying to get away from him. When I explained why I got off, he did not believe me. Now I am being charged with evading him. How do I show that I did not do it on purpose?

There is a fine line between eluding arrest and not eluding arrest. There really isn't any real way to prove one or the other. It is a matter of trying to convince the DA, Judge or Jury that one is more accurate than the other.
