How do we re assume our home loan? 1 Answers as of February 17, 2012
Our home loan was not re-assumed after our Chap7 bankruptcy, we wanted to re-assume. What are my options? Walk/re-fi/keep paying and hope they don't increase the payment amount once we have equity? I tried calling the mortgage company but they are too worried about who is responsible for failing to re-assume. With the housing market, we are about 40K underwater. Will it hurt my credit if I walk? It sounds like the house is not in my name now, due to the re-assume form. I would have been happy to re-file and keep the house (even being 40K under). Be thankful you didn't screw up and reaffirm! You NEVER ever reaffirm house loans. I am sure your lawyer explained why you are in the drivers seat, didn't he? You can walk at any time with no liability, or stay and pay. You are in control. You have no problem. Congratulations!!!
