How do I resolve my car title after bankruptcy? 7 Answers as of June 03, 2011

My bankruptcy was discharged in 2010. The lien holder on my car has not requested the final payment on my vehicle. According to the clerk the payment is stale and still sitting with them. What can I do to resolve this issue?

I'm not sure which clerk you're talking about here. Make your final payment to the lender and then ask for your title. If they refuse, then you can send them a demand letter. After that, you can sue.

That's difficult. If you can't work it out with them informally, the only legal remedy is to file a "quiet title" suit to get a judicial ruling.

Call the lender. Write to the lender. Find out the actual remaining balance and pay it.

Unfortunately you will have to file a motion to reopen the bankruptcy - and then and Order to Show Cause to make it happen.

You can seek a declaratory judgment of clear title in your local court.

You do not get title to your car until it is paid in full. Under your facts there is still a final payment. Make the payment to the lender and request title to be sent at that time.

Unless you make all the payments, you do not get the title. Unless you reaffirmed in writing, they do not have to accept payments. Discuss this with the lawyer that did your bankruptcy.
