The answer depends on a number of factors. First, whether you intend on marrying before or after you petition for him. Second whether he is here or abroad. Third whether he entered illegally or legally, etc. You will need to consult with an attorney to get the proper course of action.

You file a petition for a K-1 visa with USCIS. You can find the form and instructions at www.uscis.gov. You will need to complete the form as well as submit the required supporting evidence to demonstrate that you have a genuine relationship. This includes things such as phone records, letters, online correspondence, photographs, travel records, statements from individuals who know you as a couple, etc. You must also demonstrate that you have the intent to marry within 90 days of your fiance's entry. Assuming your fiance has no prior immigration history or other issue that would result in her not being allowed into the U.S., the petition will be granted. It is important that you and your fiance marry within 90 days of his/her entry. If you are not going to marry, it is important your spouse return to his/her native country as they will start to accrue unlawful presence and cannot extend/change their status. They can only adjust to a lawful permanent resident through marriage to you.

When a US citizen is engaged to a foreign national who is not already inside the United States, he or she can sponsor the applicant for a fiance visa. After the foreign national enters the United States, the marriage must take place within ninety days. He or she then applies for a green card with DHS. Fiance Visa Procedure: - The sponsoring USC files the non-immigrant petition with DHS - DHS forwards the petition to the National Visa Center for security checks and other processing - The NVC forwards the petition to the U.S. Consulate in the fiances home country - The fiance goes to interview and obtains a K-1 fiance visa It is important that these cases are prepared carefully and that your relationship is well documented. A lot of cases are denied for fraud, even when the relationship is bone fide, because the consular officer does not believe that the couple is legitimate.
