He has a choice. He can wait for immigration reform or you can petition him but he will have to leave and apply for a waiver. He is subject to a 10 year bar for his unlawful presence and must apply for a waiver to remove it. He can stay outside the country for a year waiting for USCIS to approve the waiver. You never really know how long it will take.
