What do I do when my child's father took my baby out of my arms and leaves? What brings me my baby back ? She is on my case and lives with me and won't let me see her and we haven't been to court and I know what he do. I can send him to jail at any time and we had a bad fight. What do I do? If a child has been kidnapped, then law enforcement should be contacted immediately. With regards to a custody dispute, the family court looks at the best interest of the children, which include many factors, as enumerated uner NRS 125B. It is typically presumed that custody should be joint, so you will need to be prepared to show the judge why he should award primary custody. An attorney can assist you in preparing evidence and understanding which facts would be important to the judge.

In Colorado you need to file a petition to allocate parental responsibilities; Colorado no longer uses the term "custody". Since you apparently aren't married to the father, you may also need to get a paternity determination to verify whether he even has any legal rights. Once you have the case in progress a judge can enter appropriate orders requiring return of the child and setting up a schedule for when each parent will have time with the child.

It is difficult to answer you b/c you have told the story w/o telling the story. I will say this if you have not been to court you need to file an action (either a dissolution or paternity action) and have the court issue temporary orders until the case can be heard. Assuming you are not married, you already have full custody. Call the police, accuse him of kidnapping, have him arrested, and have the police give you the child. And see a domestic relations lawyer now to plan what to do if he seeks custody. Also get to the Department of Job and Family services and go for child support. If he is paying you he can't pay a lawyer.
