How do I gain custody of my children in California? 1 Answers as of February 06, 2012

I have three kids that live with their mother in California and I would like custody of them. I have a job and a home and can provide for them. The mother has no job, does drugs, has eight kids and is living off of welfare and my kids do not attend much school because the mother would not enroll them for half the year. Is it possible for me to win?

Unfortunately, in family law there is a lot of he said, she said, and the courts do require some proof. If she has a history of drug use, that might be enough for the court to order a drug test based on your representations. If she does not have a history of drug use, then you alleging she is doing drugs might not be enough to have the court order a drug test.
