How different does an idea have to be to not infringe on a patent? 1 Answers as of October 29, 2010

I can improve software, but since somebody has the patent on that product, I wanted to know how different my improved product has to be from the existing product in order to patent and/or market the improvement. Can you just give me the general before I talk to someone?
