How could I bring my boyfriend to the U.S.A on a fiance visa? 12 Answers as of October 18, 2011

I want to bring my boyfriend to the U.S but I haven't married him so I know I could bring him as my fiance, but he will be getting a certain visa or permit. I would like more information and kind of the rules or certain steps we would have to follow if I decide to do this.

You would file a I-129F seeking a K-1 visa. After the US consulate in his home country approves the visa, he may come to US and has 90 days to marry you. Then he would file for adjustment of status (I-485) and become a permanent resident. You should retain an immigration attorney.

You start the process by filing the form I-129F with USCIS. The instructions with the form can be confusing, so you should consult with an immigration attorney.

You cannot unless you are engaged. If you are and you have physically met in the past two years, then you will file the I-129F petition with the USCIS detailing your relationship. After it is approved, he will then apply for the K-1 visa at his home consulate. When he enters the US, you must marry within 90 days and then you file for his permanent residence.

To file the fiance visa, you have to file an I-129 F with the USCIS. You have to demonstrate that the relationship is bona fide, that you have personally met and that you will get married within 90 days of entry. In 4-6 months, the USCIS will approve the petition and forward the petition to the National Visa Center. There are additional forms and filings you have to make at that point before the case is transferred to the consulate for an interview. At the interview at the consulate, your fiance will be interviewed and if granted the visa, he will be issued a K-1 visa in his passport. Once he enters the U.S. you have to be married within 90 days. As a K-1 visa holder he is work authorized incident to his status and after the marriage, he will be eligible to file for permanent residence.

You can petition for your boyfriend to receive a K-1 visa. This visa allows the petitioner to file for a fianc. You must be able to demonstrate that you and your fianc have a bona fide relationship. You can demonstrate this by submitting phone records, letters, copies of online correspondence, travel records, photographs, etc. You will also need to show your boyfriend is otherwise eligible to come to the United States (i.e. he has no prior negative immigration history, criminal history, etc.). In addition, you must also show you intend to marry within 90 days of his entry into the United States. If you do not marry within the 90 days, he must return to his country. He will not be able to change or extend his status unless you marry and the appropriate applications are filed with USCIS.

Bringing your fianc to the United States is a complex and sometimes frustrating process. The following is a generalized overview: The petitioner (you) files the appropriate paperwork and accompanying documents to USCIS. USCIS processes the package and upon approval the case is forwarded to the National Visa Center and then to the U.S. Embassy in your fiancs country. The Embassy processes the paperwork and sends your fianc notification of receipt and a checklist of documents required as well as certain forms to complete. The beneficiary next attends a medical examination. Finally, the beneficiary interviews at the Embassy. Upon approval the fianc enters the United States on a K-1 visa. The beneficiary applies for a social security number, marriage certificate (with you) and the parties marry within ninety (90) days of entry. This is just the beginning.

In order to bring a fiance(e) to the United States, you must apply for a K1 Visa. This isoften referred to as the Fiance(e) Visa. You must apply while your fiance is abroad. Once the proper documents are received and processed at the Embassy or Consulate, your fiancee will asked to appear for an interview at the Embassy located in his/her country. The determination is then made by the Foreign Service Officer on whether to approve the application. If approved, your fiance will enter the U.S.on a 90 day condition during which time you must marry.

You need to file an I-129F Fiance Petition in the United States. Once that is approved, then he will need to undergo the visa process to obtain the K-1 Fiance visa. The fiance process is considered a "hybrid" visa in that it is technically a non-immigrant temporary visa - a definite period of time - but because the person will eventually marry a US citizen, the fiance will be eligible for permanent residence. Thus, the person is screened like an immigrant during the visa process. Once the person enters on the K-1 visa, they must marry the US citizen within 90 days of entry. Thereafter, the foreign national is eligible for permanent residence through the adjustment of status process.

If you are a U.S. citizen, you can bring your boyfriend to the U.S. with a fiance visa. This is done with an I-129F application and all of the supporting documents. You must prove that the two of you have met face to face (no internet romances without traveling to visit) and that you are both able to and going to marry. When he comes to the U.S. with the fiance visa, both of you must get married within 90 days of his arrival or else he must go back to his country.

This is called a K visa and it is exactly what is needed. The rules are not very complicated but it is best to consult with an attorney before applying. Certain countries are more difficult than others and will require more proof of the relationship.
