How can you put your name on a deed in an estate? 1 Answers as of November 07, 2011

A friend's mother passed away and did not leave a will. She left a house which is in her and her husband's name. He now has the task of trying to sell the house but his name is not on the deed. How can he get his name put on the deed?

Property left in an individual's name, at death, must go through probate (unless the property was jointly owned or has a beneficiary designation). In your friend's case, he will need to contact a probate attorney to probate the estate and, only then, can title to the property pass from the decedent to your friend. He will not be able to sell the house without clear title.
