How can I remove conditions of affadavit of support? 3 Answers as of June 20, 2011

I am married to a Chinese woman. The deadline to file form I 751 is Sept 21, 2011. I am not going to sign this form. I want to revoke my affidavit of support. Is this possible? She's willing to get a divorce at this time so she can file her own I 751, but I don't want to be responsible for her if she remains in the USA. However I would like to be divorced while she is agreeable.

If you are ready to be divorced, you can, but your affidavit of support is NOT able to be revoked. Only if there's a death, naturalization, residency abandonment, or sufficient work credits (for social security credits) can you be relieved. Read form I-864 and you will all the information you need.
