How can I prove that I have income for immigration? 7 Answers as of October 27, 2011

I am a US citizen but live and work in Guatemala. My father and I own a restaurant business here. I plan to get married with my boyfriend and return to the US with him. My father said that I should support him and show that I have an income. I am earning $2,000 a month. Does this count as a job? How can I prove that I have income?

You have to provide the most recent year's federal income tax return and other documentation. If you cannot provide such documentation, you can get a co-sponsor. As a U.S. citizen, you still have to file a tax return for money earned abroad.

The income must be in the US. If not eligible, you may find a co-sponsor.

If you file your federal tax return you can show your income(you may not have to pay tax depending on your income overseas). If you have not filed tax returns in the past, you should do it this year (2011).

Consult with a lawyer to determine if you qualify to give an affidavit of support. You may need an additional person to help with the support because your income is low.

Do you file income tax returns in the United States on the income you earn overseas? Do you receive pay statements? This would be sufficient proof so long as your income meets the minimum requirements, which it should assuming you make $24,000 annually. There are various methods for demonstrating sufficient income including assets, cash on hand, etc. You can show sufficient income based upon both earnings and assets. It really depends on each case. You will be required to demonstrate that you can financially support your husband. If you cannot meet the income requirements or have difficulty documenting your ability to meet the requirements then you can have a joint sponsor. A joint sponsor must be able to meet the requirements for his/her own household plus your husband. It may be in your best interests to find a co-sponsor who is living in the U.S. and filing taxes here. Based upon what you have told me so far, it may be best to retain an experienced immigration attorney.

The government will request your most recent personal tax return, recent paycheck stubs and a current letter of employment to determine whether you meet the poverty guidelines for the affidavit of support.
