I have been arrested in California. After 2 days in jail, they let me out. When I went to the court house property release department they said I need to have a release form from a police station to pick my stuff up. You need to contact the police department to see if they are holding your property as evidence. If so you they may be charging you with an offense. If not you will get it back. As far as finding out what is going on your best bet would be to contact an attorney to make such inquiries for you. They will know what to do and may also help with getting your property back if you have any problems.

If your property is going to be used as evidence in the possible case against you; you may never get it back. If the state has determined that the property will not be used as evidence then you should go to the police station and request that it be returned. The status of your property should be told to you when you go to collect it.

Hire an attorney to make the inquiries. I wouldn't try to handle myself if I were you. You could unintentionally incriminate yourself trying to deal with law enforcement. The attorney will know how to deal with it.

The police department is not likely to release your property until after a conviction or dismissal has been obtained- especially if it is the subject of litigation. If you hire an attorney, she can request that the Judge order your property to be released.
