More to the point, if you already handled the DUI, went to court, paid your fines, did your time, finished your probation, etc. That case is over. If you didn't, and there is an arrest warrant out for you, then yes, you need an attorney.

You should look for someone with experience, that you get along with, who is charging you fees that you can afford, and is personable enough that they will return your calls and answer your questions. Really, it's a question of who you are comfortable with and who you can trust. There are pros and cons to any lawyer you hire. There are some lawyers who specialize and devote their entire careers around defending these cases. They have a knowledge base and expertise which is very difficult to replicate. However, they tend to charge the most money. Unless you have significant financial resources available, they may not be interested in taking your case. There are some general practitioners who practice lots of areas of law and take these cases as well. They may charge the least amount of money. Some of these general practitioners know their local area so well they can get great results for their clients regardless of the circumstances. However, there are some general practitioners who may not be interested in devoting the time and effort to properly defend the matter and may just simply try to convince you to accept the first plea-bargain that comes along. In some situations, regardless of who you hire, your options may still be the same. If the facts are very strong for the prosecutor, there some situations where there is little any defense attorney can do other than try to negotiate the best possible plea. If you don't want to spend the money to retain a lawyer, the court may appoint you a lawyer payable at the public's expense if you are eligible. The availability of court-appointed council and quality of court-appointed representation varies significantly from county to county and court to court. Communication issues, money concerns, and disagreements over strategy are often the big reasons why an attorney-client relationship breaks down. Asking around may be a good way to find a lawyer, but more importantly, make the phone calls yourself and talk to them.

How do you hire a good lawyer? That is a question that no matter what attorney you ask, will most likely be answered with "Hire me." Ask around, talk to one or more lawyers, ask how many DWI cases they have handled, what was the last DWI class they took, how much of his/her practice is criminal and of that what percentage is DWI law. Whatever you do, do not hire a lawyer because he/she is cheap or available on short notice, etc. You want experience, not price.

If you did everything the court required you to do when you got your DUI, you should be eligible for a license. Before you hire an attorney, I would suggest that you contact the DOL and find out if there is a hold on your license and if there is, what the hold is for and what DOL requires for you to have your license released. Depending upon what they tell you, you may not need an attorney. If you do need one, I would suggest looking for one in your area. This issue should not be a terribly difficult one to resolve.

First, call the DMV and find out exactly what they need from you to get your license back (fines paid, DUI class, re-referral, etc.) If it's only things that don't require a court appearance then you don't need an attorney. If you do, then call your local county bar and ask for a referral to a DUI attorney; there should be many. Any DUI attorney should be able to help you pretty easily.

The best way to find a good criminal defense is, just as with any kind of attorney, by referral from a friend or another attorney who is familiar with the attorney's work. If that is not possible you should attempt to find a criminal law specialist certified by the State Bar of California. While this not a guarantee that you will feel that that attorney is the right person for you, it is still a guarantee of experience and reputation in that he or she has achieved that status from his own profession. In addition you can always go to local bar association Lawyer Referral Service. These services also screen the attorneys to whom they provide cases for basic experience in the area. The worst way to find an attorney is from the jail mail that one receives after an arrest. These attorneys merely pay someone for access to this information and appears the only way they get clients, not a good recommendation. Finally, with regard to DUI's I would stay away from most DUI specialists who are often nothing more than high volume mills who take discount retainers and do little more than plead you guilty at the earliest opportunity without investigating the case thoroughly. However you select should be someone with whom you fee comfortable, can talk to and whom you can trust.

Reinstating your driver's license from the Secretary of State is not an easy process. You must communicate to the SOS that not only have you completed all the requirements of your DUI sentence but that: you understand what caused you to lose your license; that you've addressed those issues; and that you will be a safe and responsible driver in the future. Hire a lawyer who understands the requirements of the SOS.

Do research online to find out about your attorney. Speak with people you know about attorneys they may know. Or, if you have any friends who are attorneys, they may know a good criminal attorney in the area. Don't pick the first attorney you speak with, or one who promises guaranteed results. Talk to a few attorneys (unless you find one who come personally and highly recommended) and decide with whom you feel the most comfortable.

You should hire an attorney who has experience in this sort of matter. For example, if in the Sterling Heights area, you could call my office. I have 25 years of legal experience. You present a situation that needs more explanation. The current laws would require that you have 2 or more prior convictions to get your license completely taken away. So there seems that something may be missing. The steps in getting your license back involve showing proof of sobriety. This will include showing the most recent 6 months prior to your hearing at the Secretary of State that you are in some type of treatment, like AA or counseling. It is not enough that you did things years ago. You need to convince the SOS, and just saying that you stopped drinking may not be enough. You will also need an alcohol assessment and letters of reference. When you find an attorney who is familiar with these things, you will have the attorney who can assist you best.
