How can I fix my husband's and daughter's papers? 5 Answers as of January 30, 2012

I wanted to know if there's any way I can fix my husband's papers and my daughter's. I am under age, but I was born and raised in US and I came to Mexico, met my husband, got pregnant and had my baby her in Mexico. He never tried to cross and never been in US.

When you say you are underage, what do you mean, exactly? Are you 18? Under 18? Did you legally get married according to the laws for marriage in Mexico? If so, you should be able to petition for your husband and child to immigrate to the US as spouse and child of a US citizen.

If you are under age, then you will have to wait to be of age in order to do anything for your husband and daughter. Hopefully the daughter is a minor so that she can be included in the application you will file for her father. One of the things that you will need to establish is domicile here in the US. You have to show that you have lived here in the US for at least 2 years in order to be able to sponsor your husband into the US. You may want to think about coming back and working in the US before filing for a visa for your spouse and while you wait to be of age. I hope this helps.

If you are a USC and married to a Mexican, you can sponsor your husband for a green card through consular processing. Your daughter is probably a US citizen so you can file with the US consulate for her certificate of naturalization that they issue for US kids born abroad.
