How can I change my father's power of attorney? 2 Answers as of February 09, 2012
I recently discovered that my father was placed in a nursing home by his sister; she told the facility that she is his only family. She has taken power of attorney and she never once tried to contact me to inform me of my father’s condition. Is there anything that I can do to change this?Free Case Evaluation by a Local Lawyer!

You can not. Only your father can change his power of attorney, provided he retains the capacity to do so. However, as his closest next of kin you should be able to get information about his condition from the facility. You should consult an elder law attorney or the local authorities in charge of elder abuse matters if you feel that your aunt has not properly cared for your father.

If he is competent, he has the right to give a Power Of Attorney to any one he chooses. Only if he is incompetent or was coerced when he signed, then the Power Of Attorney may not be valid.
