false charges of drugs followed by theft of property while in jail 2 Answers as of January 07, 2011My daughter in Florida and her partner were reported to the police as drug dealers, arrested and put in jail. All charges were found to be unfounded and were dropped. But while she was in jail the landlord who made the false report at the instigation of yet another party with a grudge against them took all of her furniture and other personal possessions, and reported her auto so it was repossessed. He also filed an eviction claiming she had not paid rent but then cashed the cashier's check she had given him to pay the rent before its due date. She was freed with the clothes she stood in, no belongings, and no money. She intends to file for fraud, slander, libel and theft. Slander and libel are hard to prove. Is there some specific charge for knowingly making false accusations and using the police to exact revenge?

You could talk to the prosecutor about filing charges for making false reports to police and there is a civil action for malicious prosecution that you could potentially file. Of course, it sounds like there are some landlord/tenant issues there also. Check with the police about the making false reports if you are seeking criminal prosecution of the individual. Good Luck.
